The Lagos State High Court has ruled that the removal of Mudashiru Obasa as Speaker of the Lagos State House of Assembly was illegal and unconstitutional.
The judgment was delivered on Wednesday by Justice Yetunde Pinheiro. The court cancelled the House proceedings and resolutions from January that led to Obasa’s removal.
Obasa had filed a suit against the Lagos State House of Assembly and Mojisola Meranda, who was named as the new speaker. He said the decision to remove him was made while the Assembly was on recess and he was out of the country.
He also argued that the session was held without his knowledge or official approval. According to him, this violated the House’s rules and the 1999 Constitution.
His legal team based the case on nine grounds, including sections of the Constitution and the Standing Orders of the Lagos Assembly.
The court agreed with his arguments and ruled that the removal process did not follow due process. It declared all decisions made in that session invalid.
