NBA Slams Judge Over ‘Kneel Down’ Order

The Nigerian Bar Association has condemned a reported courtroom incident involving Justice Mohammed Umar, describing it as inconsistent with judicial standards and the dignity of the legal profession.

The controversy stems from proceedings in a case involving activist Omoyele Sowore, who is being prosecuted by the Department of State Services over alleged cyber-related offences.

According to reports, the judge ordered Sowore’s lead counsel, Marshall Abubakar, to kneel during a court session at the Federal High Court in Abuja following a disagreement over courtroom conduct.

The NBA, in a statement issued by its President, Afam Osigwe, expressed concern over the directive, saying it raises serious questions about adherence to due process and professional ethics.

The association stressed that while judges have the authority to maintain order in court, such powers must be exercised within the limits of the law.

It stated that asking a lawyer to kneel is not a recognised judicial sanction and does not align with acceptable standards of courtroom conduct.

“The courtroom is a temple of justice, governed by law, procedure and decorum,” the NBA said, warning that judicial authority must always respect the dignity of all parties involved.

The body also noted that contempt proceedings, where applicable, must follow established legal procedures to ensure fairness and objectivity.

While addressing lawyers, the NBA urged legal practitioners to remain respectful and maintain decorum, even when strongly disagreeing with the court.

Reacting to the incident, Sowore criticised the development, questioning the state of justice in the country.

Human rights lawyer Inibehe Effiong also condemned the alleged directive, describing it as unacceptable and inappropriate in a judicial setting.

The NBA reaffirmed its commitment to upholding the rule of law and judicial integrity, adding that it may engage relevant authorities to address the situation and prevent a recurrence.
